Frequently Asked Questions

How long does a divorce take in Texas?

Texas has a mandatory 60-day waiting period from the date a divorce petition is filed to the date a divorce can be finalized (Texas Family Code Section 6.702). Uncontested divorces where both spouses agree on all issues typically take 60-90 days. Contested divorces involving disputes over property, custody, or support commonly take 6-12 months, and complex cases can take 18+ months. Factors that lengthen timeline: contested custody, business valuations, hidden assets, or one spouse refusing to cooperate. Mario Yague Law works to resolve cases efficiently while protecting your rights.

How is property divided in a Texas divorce?

Texas is a community property state. Assets and debts acquired during marriage are presumed to belong equally to both spouses, regardless of whose name is on the title. Separate property, owned before marriage or received during marriage by gift or inheritance, stays with the original owner. Courts divide community property in a "just and right" manner, which is usually 50/50 but can be unequal if factors like fault in the breakup, earning capacity, or fraud justify it. Identifying and valuing all assets (including retirement accounts, businesses, and hidden assets) is critical. Mario Yague Law works with forensic accountants when needed.

Can I modify child support?

Yes, Texas allows modification of existing child support orders when there has been a "material and substantial change in circumstances" or when 3+ years have passed since the last order AND the new calculation would change the amount by 20% or $100, whichever is less. Examples of qualifying changes: significant income increase or decrease, job loss, change in custody arrangement, child’s needs change (medical, educational), or paying parent has additional children. Modifications require a formal motion in court, informal agreements between parents are NOT enforceable. Mario Yague Law handles support modifications for both paying and receiving parents.
